An affidavit is a written statement of facts that you swear or affirm to be true before a person authorised to administer an oath. It is made in the first person, signed by you as the deponent, and closed with a verification clause. The oath is administered under the Oaths Act, 1969.
What every affidavit must contain
Five parts, in this order. An affidavit that is missing the verification clause is the commonest reason an office sends one back.
- Title and the office it is addressed to. What the affidavit is about, and the authority it is made for.
- Deponent details. Your full name as it appears on your identity documents, your parent's or spouse's name, your age, your occupation and your address. If your name is spelled differently across documents, say so here, because that mismatch is often the reason for the affidavit.
- Numbered paragraphs of fact. One fact per paragraph, in the first person, in plain language, in chronological order. State only what you know to be true of your own knowledge, and say which paragraphs are based on information and belief rather than personal knowledge.
- Verification clause. A closing paragraph confirming that the contents are true and correct to the best of your knowledge, that nothing material has been concealed, and that no part of it is false. This is what turns a statement into an affidavit.
- Place, date, signature and attestation. You sign as the deponent, and the notary or other authorised officer signs and stamps to certify that the oath or affirmation was administered. Sign every page.
Who can administer the oath. Section 139 of the Code of Civil Procedure, 1908 and Order XIX deal with affidavits, and under the Oaths Act, 1969 the oath is administered by a person authorised to do so, which in practice means a notary appointed under the Notaries Act, 1952, a magistrate, or an officer appointed as a commissioner for oaths.
An affidavit is a sworn document. A false statement in it can expose the deponent to prosecution, so do not sign one you have not read.

Stamp paper, notarisation and registration
Three separate things, and readers routinely confuse them.
Stamp paper. An affidavit is executed on non-judicial stamp paper of the value the state requires. Stamp duty is a state levy under the relevant State Stamp Act, or under the Indian Stamp Act, 1899 as applied to that state, so there is no national figure. In West Bengal the stamp duty on an affidavit is ₹10 under Article 4 of Schedule IA, as published by the Directorate of Registration and Stamp Revenue. For every other state we confirm the amount before execution rather than publish a figure we cannot verify. Some states issue stamp paper electronically and some over the counter, so the form differs even where the amount is small.
Notarisation. The deponent signs before the notary, who administers the oath or affirmation and then signs, stamps and enters the affidavit in the notarial register. Notarial fees are prescribed centrally under the Notaries Rules, 1956. We have not verified the current amount, so we charge it at actuals rather than publish a figure.
Registration. An affidavit is normally not registered. Section 17 of the Registration Act, 1908 makes registration compulsory only for a short list of instruments, mainly those creating or assigning rights in immovable property, and an affidavit is not on that list. If you do choose to present one for registration in West Bengal, the registration fee is ₹7 under the Table of Fees fixed by the State Government under the Registration Act, 1908.
For most purposes a notarised affidavit on correctly valued stamp paper is what the office wants. Ask the office whether they want the original or a notarised copy, because that decides how many originals we prepare.
Name change: the affidavit is step one of three
Changing a name properly is a sequence, and the affidavit on its own does not finish the job.
Step 1. The affidavit. Sworn before a notary, stating the old name, the new name, the reason and the date from which the new name applies.
Step 2. Newspaper publication. An advertisement in one English and one regional-language newspaper, carrying the old name, the new name and your address. Keep the original cuttings, because the gazette office and the passport office ask for them.
Step 3. Gazette publication. A name change is published in the Gazette of India through the Department of Publication, which issues separate guidelines for an adult, for a minor, and for a change of name and gender. States run their own gazettes with their own forms and their own process, so a person in Kolkata, Delhi or Bengaluru may go through the state gazette instead. We check which route the office asking for the proof will accept, and we do not publish fee figures for gazette publication because we have not verified them.
Then update documents in a sensible order: PAN, Aadhaar, bank, passport, employment and education records. Doing PAN and Aadhaar first saves repeat affidavits later.
