Class 5 and the deceptive similarity standard
Pharmaceutical preparations sit in Class 5. Courts and the Registry apply a stricter standard of deceptive similarity to medicinal marks than to ordinary goods, because confusion between two drug names carries a public health consequence rather than a commercial one.
The practical effect is that marks which would coexist comfortably in another class are refused in Class 5. Names built from the same active ingredient stem, which is a common industry convention, sit particularly close to each other and need careful clearance rather than an assumption that the convention protects them.
INN stems and what cannot be monopolised
International Non-proprietary Name stems are the common syllables that identify a drug class. They are deliberately available to the whole industry, and a mark that consists of or closely follows an INN stem is weak - both to register and to enforce.
A brand built on a distinctive prefix attached to a recognised stem is the usual compromise, and the strength of the mark lives in the prefix.
Which Trade Marks Registry office handles a Hyderabad filing
There is no Trade Marks Registry office in Hyderabad, and none anywhere in Telangana. India has five Registry locations: the Registry itself is at Mumbai, and its four branches are at Kolkata, Chennai, Ahmedabad and New Delhi. A Hyderabad applicant files at the Chennai office, whose territory takes in seven jurisdictions: Telangana, Andhra Pradesh, Karnataka, Tamil Nadu, Kerala, Puducherry and Lakshadweep.
Territorial jurisdiction follows the applicant's principal place of business in India, or the address for service in India where there is no place of business here. It is not the city your agent works from, and nothing is gained by hiring a Chennai agent for a Chennai file. The Chennai office issues your examination report, lists any show cause hearing, and handles every later form. Filing and fee payment are online.
Worth knowing if you are comparing notes with a Bengaluru counterpart: you file to the same office they do. Everything else about your two positions differs, because Telangana and Karnataka run separate professional tax Acts, separate shops legislation and entirely different municipal arrangements.
What Telangana costs a business around the filing
Professional tax, on the state's own module. Telangana levies professional tax under the Telangana Tax on Professions, Trades, Callings and Employments Act, 1987, administered by the Commercial Taxes Department. New registrations, payments and return filing run on the department's own professional tax module at ptax.tgct.gov.in, reached from the Profession Tax tab on the department's portal. Telangana operates two things: registration for an employer deducting from salary and enrolment for the business or professional in its own right. The department's own pages call them registration and enrolment, not PTEC and PTRC, so ask for them by the names the officer will recognise. The Constitution caps the levy at ₹2,500 per person per year under Article 276(2). We confirm the slab that applies to your payroll from the department's Schedule rather than quoting a figure here.
Shops and establishments. The Act is the Telangana Shops and Establishments Act, 1988 (Act No. 20 of 1988), with the Telangana Shops and Establishments Rules, 1990, administered by the Labour Department at labour.telangana.gov.in. It is registration with a certificate issued, and we confirm the current fee with the Department before quoting it.
The municipal position changed in February 2026, and most advice has not caught up. Hyderabad was reorganised from one municipal corporation into three: the Greater Hyderabad Municipal Corporation with 150 wards, the Cyberabad Municipal Corporation with 76 wards and the Malkajgiri Municipal Corporation with 74 wards, taking effect in February 2026 on the expiry of the GHMC council's term.
Two corrections follow from that. GHMC has not been abolished, unlike Bengaluru's BBMP, so naming GHMC is not wrong. But GHMC no longer covers all of Hyderabad, so a page telling you that every Hyderabad licence comes from GHMC is out of date. Which corporation your premises falls under depends on the ward, and we confirm it by address rather than assuming.
If you are incorporating alongside the trademark. ROC Hyderabad and the Regional Director for the South East Region, at Hyderabad, are both unchanged by the 2026 company law reorganisation, while Delhi, Mumbai, Kolkata, Noida and Haryana were all rearranged. One correction if you are reading older material: the Hyderabad Regional Director does not cover Karnataka. Karnataka, Kerala and Lakshadweep moved to the new Regional Director at Bangalore on 16 February 2026. Telangana stamp duty on the memorandum and articles we quote before you pay, and we will not publish a figure: the only compilation available to us predates the 2014 bifurcation and lists Andhra Pradesh, so any Telangana number taken from it is a guess.
What a Hyderabad business usually files alongside
Get Udyam registration or DPIIT startup recognition before the trademark rather than after: either one, held validly and attached to Form TM-A at the time of filing, halves the government fee from ₹9,000 to ₹4,500 per class. Pharma and API exporters need an IEC registration, and GST registration is separate from all of it. TS-iPASS at ipass.telangana.gov.in is Telangana's single-window industrial approval system.

Export markets and the limits of an Indian registration
A trademark registration is territorial. An Indian registration protects you in India and nowhere else, which matters for a Hyderabad pharma or API business selling into regulated export markets.
The Madrid Protocol allows an international application based on an Indian application or registration, designating multiple countries in one filing. It is filed through the Indian registry as office of origin and is materially cheaper than filing country by country.
