Component manufacturers and the B2B brand question
Auto component and engineering businesses often supply under an OEM's brand and assume their own name needs no protection. It does, for two reasons.
The company name is used on quotations, catalogues, exhibition stands and export documentation, and it is the name a buyer searches. And where a component business builds an aftermarket or replacement-parts line, that line is sold under its own brand into a market where copying is routine.
The classes follow the goods - Class 7 for machines, Class 12 for vehicles and parts, Class 9 for electrical and electronic components - with Class 42 where engineering services are supplied.
Education and training institutions
Institution names and course brands sit in Class 41. This is a category where descriptive names are extremely common, and Section 9 refuses marks that lack distinctive character or merely describe the service.
A name built from a place and a subject is weak on its own. Where an institution has traded under such a name for years, acquired distinctiveness can be argued, but it requires substantial documented use - enrolment records, advertising, dated prospectuses.
The Udyam fee slab in a manufacturing city
Pune has a dense population of Udyam-registered enterprises. Where the applicant qualifies as a small enterprise, the government fee is ₹4,500 per class rather than ₹9,000.
The Udyam certificate must be attached to Form TM-A at the time of filing. It cannot be claimed afterwards and there is no refund.
