Class 35 does not protect your product brand
This is the single most common and most expensive mistake among marketplace sellers, and it recurs constantly.
Class 35 covers retail and business services - running a shop, advertising, business administration. It protects the name of the retail service. It does not protect the name of the goods you sell under that name.
If you manufacture or private-label mobile accessories, the mark belongs in Class 9. Apparel belongs in Class 25. Appliances in Class 7 or 11 depending on the goods. A seller registered only in Class 35 who finds a competitor selling identical goods under the same brand has a much weaker position than they believe they have.
Where you genuinely operate a retail platform as well as selling your own goods, both are appropriate. Class 35 alone, for a product business, is not.
Marketplace brand registry and what it needs
Amazon Brand Registry, Flipkart and the other marketplaces accept applications at different stages, and the requirement moves. What is consistent is that an application number gets you further than nothing, and a registration certificate gets you furthest.
The practical consequence for a Noida seller is that filing early matters more than filing perfectly. An application number is generated within twenty-four hours of filing, and you can use the ™ symbol from that point. The ® symbol may be used only after registration, and using it before is a punishable offence.
Manufacturing businesses and the fee slab
Uttar Pradesh has a very large Udyam-registered manufacturing base, and the reduced fee slab under the Trade Marks Rules, 2017 is available to a small enterprise holding a valid Udyam certificate.
That takes the government fee from ₹9,000 to ₹4,500 per class. The certificate has to be attached to Form TM-A at the time of filing, and it cannot be claimed afterwards.
