POSH Compliance in Kolkata
Internal Committee, policy, training and annual report, run from our Lake Town head office
Every employer in Kolkata with 10 or more employees at a workplace must constitute an Internal Committee under the POSH Act, 2013, adopt a written policy, train staff and send an annual report to the District Officer. Regikart's head office is in Lake Town, so our company secretaries can meet you, review your existing committee order and run sessions at your premises by arrangement.
The rules are national, and our POSH compliance guide explains them. What is particular to Kolkata is geography: a business with a Kolkata postal address may sit in Kolkata district, or in North 24 Parganas, Howrah or South 24 Parganas, and each district has its own District Officer and Local Committee. This page covers how that plays out for city employers.

Which employers in Kolkata must comply
The District Officer and Local Committee for Kolkata
Section 5 of the Act lets each state notify a District Magistrate, Additional District Magistrate, Collector or Deputy Collector as the District Officer for every district. The District Officer constitutes the district's Local Committee under section 6, which hears complaints from workplaces with fewer than 10 workers and complaints against the employer, and names nodal officers in each ward or municipality to receive complaints and forward them within 7 days.
For a Kolkata employer, the practical point is which district your workplace is in, because the postal address does not settle it:
- Kolkata district covers the core city, including the central business district around Dalhousie and Park Street.
- North 24 Parganas includes the Bidhannagar subdivision (Salt Lake and Sector V) and New Town and Rajarhat.
- Howrah is a separate district across the river, where many warehouses and units sit.
- South 24 Parganas covers much of the southern fringe.
Your annual report goes to the District Officer notified by the West Bengal government for the district where that workplace is, and your policy should name that district's Local Committee for small units and complaints against the employer. We have not found a current official West Bengal page that names the designation or lists the Local Committees, so we confirm the office for each of your districts before your first report rather than rely on an old list.
The same check applies when you move. A business that shifts from a Park Street office to New Town, or opens a second floor in Sector V for a new team, changes district or adds a unit. The committee order, the display notice and the Local Committee named in the policy should be updated at the same time, and the next annual report goes to the new district's officer.
Filing the annual report from Kolkata
Under section 21 and rule 14, each Internal Committee prepares a report for every calendar year, covering complaints received, disposed of and pending beyond 90 days, awareness programmes held and action taken. It goes to the employer and to the District Officer, and is due even in a year with no complaints.
We have not found an official West Bengal portal or notified e-mail address for these reports. Unless your district has issued its own instruction, the safe course is a signed hard copy delivered to the District Officer's office, with a covering letter, and the receiving stamp kept on file. Where a district asks for a different format or mode, we follow that instruction. Separately, the employer can register its workplace on the Ministry of Women and Child Development's SHe-Box portal; that does not replace the report.
Worked example: one company, three districts
Illustrative only. A Kolkata trading company has its head office on Camac Street, a warehouse in Howrah and a sales branch in Salt Lake Sector V.
| Unit | District | Headcount (incl. contract staff) | Own Internal Committee? | Annual report goes to |
|---|---|---|---|---|
| Head office, Camac Street | Kolkata | 42 | Yes | District Officer, Kolkata district |
| Warehouse | Howrah | 16 (including loaders through a contractor) | Yes | District Officer, Howrah |
| Sales branch, Sector V | North 24 Parganas | 6 | Confirm the route with us | District Officer, North 24 Parganas, if a committee covers it |
Three things follow. The warehouse needs its own committee even though most of its workers are on a contractor's rolls, because section 2(f) counts them. Each committee files its own report with its own district. And the company's Board's report, under rule 8(5)(x) of the Companies (Accounts) Rules, 2014, must state that Internal Committees have been constituted and, since the Companies (Accounts) Second Amendment Rules, 2025 took effect on 14 July 2025, give the complaints received, disposed of and pending beyond 90 days. Those figures should add up across all three units, so we prepare the district reports and the Board's report disclosure from the same register.
The rules, at a glance
| Who must comply | Every employer with 10 or more employees must constitute an Internal Committee at each office or administrative unit (section 4) |
|---|---|
| Internal Committee | A senior woman employee as Presiding Officer, at least two employee members and one external member; at least half the members women; term of up to 3 years |
| Smaller workplaces | Complaints from workplaces with fewer than 10 employees, or against the employer, go to the Local Committee set up by the District Officer (section 6) |
| Complaint and inquiry | Complaint within 3 months of the incident (extendable by 3 months); inquiry completed within 90 days (sections 9 and 11) |
| Annual report | The Internal Committee reports each calendar year to the employer and the District Officer (section 21; rule 14) |
| Penalty | Fine up to ₹50,000; on a repeat offence, twice the punishment and possible cancellation of licence or registration (section 26) |
The Act and the 2013 Rules are the same in every state. What differs city to city is the District Officer you report to and the local administration behind the Local Committee.
Documents to keep ready
POSH Compliance fee in Kolkata
| Item | Amount |
|---|---|
| Regikart professional fee: POSH set-up for a single workplace | From ₹9,499 |
| Additional offices or units, annual report preparation, training sessions and external member arrangements | Quoted on scope |
| Government fee | Nil |
Professional fees exclude GST at 18%. There is no government fee under the POSH Act. Fees verified on 24 October 2026.
The ₹9,499 starting fee covers POSH set-up at one workplace: the policy, the written order constituting the Internal Committee, the display notice and the register formats. A Kolkata head office with a Howrah warehouse or a Salt Lake branch needs a committee at each unit, so additional units, the yearly report to each District Officer, training sessions and an external member are quoted on scope once we have your list of units and headcount. We confirm the total in writing before we start.
Working with our Kolkata head office
Regikart's head office is at 129A Bangur Avenue, Block A, Lake Town, Kolkata 700055. You can meet the CS team there, bring your current policy and committee order for review, or send everything on WhatsApp at +91 70444 94804 or to [email protected]. Awareness sessions and committee orientation are held online or on-site at your premises by arrangement. We also have offices in Delhi and Bengaluru for units in those cities.
The usual sequence
- Map your units: every office, warehouse and site, its district and its headcount.
- Policy: drafted to the Act and Rules, naming the complaint route, timelines and the Local Committee for small units.
- Internal Committee order: a written order for each unit that needs one, with a senior woman as Presiding Officer and an external member.
- Display notice: the committee details and penal consequences put up at each unit.
- Training: an awareness session for staff and orientation for committee members, with attendance kept.
- Register: complaint register and minutes format, and SHe-Box details if you choose to register.
- Annual report: prepared for each committee and delivered to its District Officer.
How long this takes depends mainly on how quickly you confirm the committee members and the external member.
Every year
Each committee's report for the calendar year goes to its District Officer, and companies carry the matching disclosure in the Board's report. We also track committee terms, which run for up to 3 years, and replace members who leave, so a unit is never without a valid committee.
